These Terms & Conditions (“Terms”) govern your use of https://phenixeco.com (the “Site”) and any purchases made through the Site.

By accessing the Site, using our services, or placing an order, you agree to be bound by these Terms.

  1. COMPANY INFORMATION

The Site is operated by Phoenix Trade LLC under the Phénix ECO brand (“Phénix ECO”, “we”, “us”, or “our”).

Phénix ECO is a brand operated by Phoenix Trade LLC and is not a separate legal entity.

  1. PRODUCTS AND MADE-TO-ORDER MODEL

Many Phénix ECO products are manufactured using a print-on-demand, made-to-order model.

Products may be manufactured, printed, packaged, and/or shipped by third-party fulfillment providers, including Printful and other service providers selected by Phoenix Trade LLC.

Because products are made individually, slight variations may occur in:

  • color;
  • print placement;
  • dimensions;
  • texture;
  • appearance; and
  • presentation.

Colors displayed on screens may also vary depending on device and display settings.

Such minor variations do not necessarily constitute defects.

  1. PRODUCT INFORMATION

We make reasonable efforts to provide accurate product descriptions, photographs, pricing, sizing information, and availability.

However, we do not warrant that all descriptions, images, colors, measurements, availability information, or other content will always be completely accurate, current, or error-free.

We reserve the right to correct errors, update information, or modify product details at any time.

  1. PRICES AND CURRENCY

Unless otherwise stated, prices on the Site are displayed in United States dollars (USD).

Applicable shipping charges, taxes, duties, customs fees, or other charges may be added during checkout or may be imposed by authorities or carriers after purchase, depending on the destination.

Prices may change at any time without prior notice.

Price changes will not affect orders already accepted by us.

  1. ORDERS

Submitting an order constitutes an offer to purchase the selected products.

We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including in cases involving:

  • suspected fraud;
  • unauthorized transactions;
  • pricing or technical errors;
  • product availability issues;
  • incorrect customer information;
  • suspected misuse of the Site; or
  • inability to fulfill an order.

If we cancel an order after payment has been received, we will provide an appropriate refund where required.

  1. PAYMENTS

Payment must be successfully completed through the payment methods available at checkout.

Payment services may be provided by third-party payment processors.

By submitting payment information, you authorize the applicable payment processor to charge the amount due for your order.

Phoenix Trade LLC does not necessarily store complete payment card information directly.

  1. ORDER CHANGES AND CANCELLATIONS

Because many products are made to order, production may begin shortly after an order is submitted.

Requests to change or cancel an order should therefore be made as soon as possible.

Once an order has entered production, fulfillment, or shipment, modification or cancellation may no longer be possible.

We do not guarantee that any requested order change or cancellation can be completed.

  1. RETURNS, REFUNDS AND PRODUCT ISSUES

Because many Phénix ECO products are made to order, we generally do not accept returns or exchanges for:

  • buyer’s remorse;
  • change of mind;
  • incorrect size selected by the customer;
  • incorrect color selected by the customer; or
  • other customer selection errors,

except where required by applicable law.

If a product arrives damaged, defective, materially misprinted, materially different from what was ordered, or if a shipment is confirmed lost in transit, please contact us promptly at:

We may request photographs, order information, shipping information, or other reasonable evidence to evaluate the issue.

Depending on the circumstances, we may offer:

  • replacement;
  • reshipment;
  • refund;
  • partial refund; or
  • another appropriate remedy.

Claims involving damaged, defective, or misprinted items should generally be submitted within 30 days of receiving the product.

Claims involving packages lost in transit should generally be submitted within 30 days of the estimated delivery date.

Nothing in this section limits any mandatory consumer rights that cannot legally be waived.

  1. SHIPPING AND DELIVERY

Orders may be manufactured and shipped from different fulfillment facilities depending on:

  • product type;
  • stock availability;
  • customer destination; and
  • fulfillment capacity.

Estimated delivery dates are estimates only and may include both production and shipping time.

Delivery times may be affected by factors outside our reasonable control, including:

  • carrier delays;
  • customs processing;
  • weather;
  • strikes;
  • natural disasters;
  • border restrictions;
  • operational disruptions; or
  • incorrect or incomplete shipping information.

Where required by applicable law, we will notify customers of material shipping delays and provide any remedies required by law.

  1. SHIPPING ADDRESS

Customers are responsible for providing a complete and accurate shipping address.

We are not responsible for delivery problems caused by inaccurate, incomplete, or outdated address information provided by the customer.

If an order is returned or cannot be delivered due to incorrect address information, additional shipping or fulfillment charges may apply where permitted by law.

  1. INTERNATIONAL ORDERS, CUSTOMS AND DUTIES

Phénix ECO may sell and ship products internationally.

International orders may be subject to:

  • import duties;
  • customs charges;
  • value-added taxes;
  • brokerage fees; or
  • other government charges.

Unless expressly stated otherwise at checkout, customers are responsible for applicable import duties, customs charges, taxes, or fees imposed by the destination country.

Customs procedures may delay delivery.

  1. THIRD-PARTY FULFILLMENT

Phoenix Trade LLC may use third-party companies to manufacture, print, store, package, ship, or otherwise fulfill orders.

These providers may include Printful and other fulfillment, logistics, payment, hosting, technology, or shipping providers.

Phoenix Trade LLC remains the seller operating the Phénix ECO store unless otherwise expressly disclosed.

  1. PROMOTIONS AND COUPONS

Promotional codes, discounts, and special offers may be subject to additional conditions.

Unless otherwise stated:

  • promotions cannot be combined;
  • promotions have no cash value;
  • promotions may expire;
  • promotions may apply only to selected products or regions; and
  • we may withdraw or modify a promotion where permitted by law.
  1. INTELLECTUAL PROPERTY

The Site and its content, including trademarks, brand elements, logos, designs, graphics, photographs, product artwork, text, layout, and other materials, are owned by Phoenix Trade LLC, used under license, or used with permission.

The Phénix ECO brand and associated materials may not be copied, reproduced, distributed, modified, commercially exploited, or used without prior authorization except where permitted by law.

No provision of these Terms transfers ownership of any intellectual property rights to the user.

  1. ACCEPTABLE USE

You may not use the Site:

  • for unlawful purposes;
  • to commit fraud;
  • to interfere with Site security;
  • to introduce malicious software;
  • to attempt unauthorized access;
  • to impersonate another person;
  • to misuse payment systems; or
  • to violate the rights of Phoenix Trade LLC or third parties.

We may restrict or suspend access to the Site where reasonably necessary to protect the Site, our customers, or our business.

  1. PRODUCTS FOR CHILDREN

Phénix ECO may offer products designed for babies, children, or families.

However, the Site and its online purchasing services are intended for adults who are legally capable of entering into a purchase contract.

We do not knowingly collect personal information directly from children in violation of applicable law.

Orders for products intended for babies or children must be placed by an adult or other legally authorized purchaser.

  1. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy.

By using the Site, you acknowledge that personal information may be processed by service providers necessary for operating the store, including payment providers, hosting providers, fulfillment providers, shipping carriers, analytics providers, and other technology providers.

  1. THIRD-PARTY SERVICES AND LINKS

The Site may contain integrations, services, or links provided by third parties.

These third parties may operate under their own terms and privacy policies.

We are not responsible for the content, availability, security, or practices of independent third-party websites or services except to the extent required by applicable law.

  1. DISCLAIMERS

To the extent permitted by applicable law, the Site and its content are provided on an “as available” basis.

We do not guarantee uninterrupted or error-free access to the Site.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Phoenix Trade LLC will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or products purchased through the Site.

This limitation does not apply where liability cannot legally be limited or excluded.

Nothing in these Terms limits liability for fraud, intentional misconduct, or any other liability that cannot lawfully be excluded.

  1. FORCE MAJEURE

Phoenix Trade LLC will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control, including:

  • natural disasters;
  • severe weather;
  • war;
  • civil disturbances;
  • government actions;
  • border restrictions;
  • labor disputes;
  • carrier disruptions;
  • manufacturing interruptions;
  • telecommunications failures; or
  • other comparable events.

This provision does not eliminate any mandatory rights available to consumers under applicable law.

  1. GOVERNING LAW

These Terms are governed by the laws applicable to Phoenix Trade LLC in the United States, including the laws of the state in which Phoenix Trade LLC is organized, without regard to conflict-of-law principles.

However, nothing in these Terms limits any mandatory consumer protection rights that apply to customers under the laws of their place of residence and that cannot legally be waived by contract.

  1. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force to the extent permitted by law.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in:

  • our business;
  • our products;
  • fulfillment processes;
  • legal requirements;
  • payment methods; or
  • Site functionality.

The updated version will be posted on this page with a revised “Last updated” date.

Changes will apply prospectively unless applicable law requires otherwise.
